1. Introduction

These Terms and Conditions govern your participation in the FAM-LY Giveaway ("the Competition") operated by the Fearless Aid Movement ("FAM", "we", "us", or "our"), accessible at www.fearlessmovement.co.za. By purchasing a ticket and submitting an entry, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety.

This Competition is conducted in accordance with the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), the Protection of Personal Information Act 4 of 2013 ("POPIA"), and all other applicable South African laws and regulations.

2. Definitions

In these Terms and Conditions, unless the context indicates otherwise:

  • "Competition" means the FAM-LY Giveaway operated by the Fearless Aid Movement.
  • "Entrant" means any person who has purchased a ticket and submitted a valid entry form.
  • "Entry Period" means the period commencing on 1 May 2026 and closing on 30 June 2026 at 23:59 South African Standard Time (SAST).
  • "Grand Prize" means the Apple MacBook Pro valued at R30,999.
  • "Ticket" means the right to participate in the Competition, purchased via the PayFast payment links on the website.
  • "Ticket Number" means the unique 8-digit reference number generated upon successful submission of an entry form.
  • "Website" means www.fearlessmovement.co.za.
  • "PayFast" means PayFast (Pty) Ltd, the third-party payment processor used to facilitate ticket purchases.

3. Eligibility

To be eligible to participate in this Competition, an Entrant must:

  • Be a natural person aged 18 years or older at the time of entry.
  • Be a resident of the Republic of South Africa with a valid South African identity document or passport.
  • Not be an employee, director, member, partner, agent, or consultant of the Fearless Aid Movement, or an immediate family member (spouse, parent, child, sibling) of any such person.
  • Have a valid South African banking account or payment method to facilitate the ticket purchase.
  • Have provided complete and accurate personal information on the entry form.

The organisers reserve the right to verify eligibility at any stage and to disqualify any Entrant who does not meet these requirements.

4. Ticket Packages & Entry

Tickets may be purchased via the following packages available on the Website:

  • 1 Ticket - R99
  • 5 Tickets - R300
  • 10 Tickets - R500

Each ticket purchased entitles the Entrant to one (1) entry into the Competition draw, regardless of the package purchased. Multiple tickets may increase your chances of winning proportionally.

The entry process is as follows:

  • Step 1: Select a ticket package and complete payment via the PayFast payment link on the Website.
  • Step 2: Upon successful payment, you will be redirected to the entry form at www.fearlessmovement.co.za.
  • Step 3: Complete all required fields on the entry form, including your full name, contact number, and email address.
  • Step 4: Upon successful submission, a unique 8-digit ticket number will be generated and displayed. This ticket number serves as your proof of entry.

An entry is only valid once both payments have been received and the entry form has been successfully submitted. Incomplete entries will be deemed invalid.

5. Payment Terms

All payments are processed by PayFast (Pty) Ltd. By completing a payment, you agree to PayFast's Terms of Service and Privacy Policy in addition to these Terms and Conditions.

All prices are quoted in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT) at the current rate where applicable.

All sales are final. No refunds will be issued once payment has been successfully processed, except where required by law (including the CPA) or where an entry is invalidated through no fault of the Entrant.

The Fearless Aid Movement is not responsible for any payment failures, declined transactions, or technical issues arising from the PayFast payment platform. If your payment fails, please contact PayFast directly or retry using an alternative payment method.

6. The Draw & Winner Selection

The draw will take place on or after 30 June 2026 at a time to be determined by the organiser. The draw will be conducted by means of a random selection process.

The winner will be selected at random from all valid entries received during the Entry Period. Each valid ticket number represents one entry into the draw.

The draw will be supervised by an independent third party or a representative of the Fearless Aid Movement who has not participated in the Competition.

The decision of the organisers regarding the winner is final and binding, and no correspondence will be entered into. No appeals will be considered.

7. Prize

The Grand Prize is one (1) Apple MacBook Pro with an approximate retail value of R30,999 (the "Prize"). The Prize is not transferable, not exchangeable, and may not be redeemed for cash. The Prize must be accepted as offered.

Should the specific Prize become unavailable for any reason beyond the reasonable control of the organisers, the organisers reserve the right to substitute the Prize with another prize of equal or greater value.

Any costs incidental to the Prize, including but not limited to insurance, import duties, delivery charges beyond the agreed delivery point, and any applicable taxes on the Prize, are the responsibility of the winner unless expressly stated otherwise.

The organisers will make reasonable efforts to deliver the Prize to the winner within the Republic of South Africa. International delivery is excluded.

8. Notification of Winner

The winner will be notified via the contact details provided on the entry form (email address and/or telephone number) within 5 (five) business days of the draw.

If the winner cannot be contacted within 10 (ten) business days using the contact details provided, or if the winner fails to respond within 10 (ten) business days of notification, the organisers reserve the right to conduct a redraw and select an alternative winner. The original winner will forfeit all rights to the Prize.

The winner's name and surname may be published on the Fearless Aid Movement's social media platforms and website as required by the CPA and for promotional purposes. The winner may be required to participate in promotional activities at the organisers' reasonable request.

9. Disqualification

The organisers reserve the right to disqualify any Entrant and void any entry that:

  • Does not comply with these Terms and Conditions.
  • Contains false, fraudulent, or misleading information.
  • Is submitted by a person who is ineligible to participate.
  • Has been obtained through fraudulent, unlawful, or dishonest means.
  • Has been tampered with or manipulated in any way.
  • Is submitted after the closing of the Entry Period.

Any attempt to manipulate or interfere with the Competition entry process or draw may result in criminal prosecution and/or civil action by the organisers.

10. Limitation of Liability

To the maximum extent permitted by South African law:

  • The organisers, their directors, employees, and agents accept no liability for any loss, damage, injury, or disappointment suffered by any Entrant as a result of participating in this Competition or as a result of accepting the Prize.
  • The organisers are not liable for any technical failures, server downtime, internet connectivity issues, payment processing failures, or any other technical problems that may affect entry or participation.
  • Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable South African law.

The Prize is provided "as is" and the organisers make no warranties, express or implied, regarding the Prize beyond those required by law.

11. Intellectual Property

All intellectual property rights on the Website, Competition materials, branding, and Prize are owned by or licensed to the Fearless Aid Movement. Entrants may not use any intellectual property of the Fearless Aid Movement without prior written consent.

12. General

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or in connection with this Competition shall be subject to the exclusive jurisdiction of the South African courts.

The organisers reserve the right to amend, suspend, or cancel this Competition at any time, subject to applicable law. Any amendments will be communicated via the Website.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

These Terms and Conditions constitute the entire agreement between the Entrant and the Fearless Aid Movement in relation to this Competition.
